These terms cover your use of rodiscales.com and our services. Rodi Scales ("we", "us") is the trade name of Brian Rodriguez, an individual sole proprietor in San Leandro, California. By using the site or our services, you agree to these terms. If you do not agree, please do not use them.
Our services are for businesses. If you use them for a business, you confirm you are at least 18 and have authority to act for it.
A guarantee or refund stated on an offer page, in its exact wording, is part of that offer, and the signed agreement for that offer repeats it word for word. Everything else on this site is general description. Scope, price and payment dates are set in the signed agreement or written quote for your work. If that document and these terms disagree, that document controls.
Marketing depends on things we do not control, including your market, your prices, how your team answers and closes, and the ad platforms themselves. Unless your signed agreement or that offer's stated guarantee says otherwise, we do not promise any number of leads, calls, jobs, reviews, rankings or any amount of revenue. Examples on this site are not a promise that you will get the same result.
A guarantee or refund applies only if it is stated for that specific offer, and only in its exact wording. It does not extend to any other offer, even if you buy them together. Otherwise, fees are not refundable except where the law requires it.
We never front, hold, advance or invoice your ad budget. It is your money, in your account, in your name. You pay the ad platforms directly, you are responsible for that spend whatever the results, and we never refund it.
You keep what you owned before working with us. Who owns the work we make for you is set in your signed agreement. Unless it says otherwise, you allow us to use what you give us as needed to do the work. We publish client names, results or testimonials only with permission. Our site, its content and our methods remain ours, and you may not copy them without our written permission.
If you tick the box on one of our forms, you agree that we may call or text you about your business at the number you gave. Message and data rates may apply, and message frequency varies. Reply STOP to opt out of texts. Agreeing is not a condition of buying anything from us. See our Privacy Policy for how we handle your information.
We may prepare a preview of a website or ad for a business, using information available about that business. A preview is a sample, not that business's official site, and it does not mean that business has hired, endorsed or approved us. If it is about your business and you want it removed, email us and we will remove it within 2 business days.
Please do not break the site or try to get around its security, submit false information or spam, or use it for anything unlawful. We may change or remove any part of the site at any time.
Our work relies on other companies, such as ad platforms, phone carriers and hosting providers. We do not control them, and we are not responsible for their outages, rule changes, account decisions or fees.
To the extent the law allows, the site and services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement.
To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or ad spend. Our total liability for any claim is limited to the greater of the fees you paid us for the service at issue in the 12 months before the claim arose or $500. These limits do not apply to fraud, willful injury, violations of law, or a stated refund you are owed.
You agree to cover claims and costs that others bring against us because of materials or instructions you gave us or your breach of these terms, except to the extent caused by our own negligence or breach.
California law governs these terms, without regard to conflict-of-law rules. Before filing a claim, please email us so we can try to resolve it. Any lawsuit must be brought in the state or federal courts located in Alameda County, California.
If part of these terms cannot be enforced, the rest still applies. You may not transfer these terms without our written permission. Notices to us go to the email or mailing address below. We are an independent business, not your employee, agent or partner.
If we change these terms, we will post the new version here and update the date at the top. Changes do not alter a signed agreement already in place.
